Is Binance licensed by the FSCA?

The FSCA’s website carries a news item, “FSCA confirms list of currently approved crypto asset service providers”, saying it “approved a total of 75 institutions to be licensed as CASPs” under the Financial Advisory and Intermediary Services (FAIS) Act; its date is not visible, so we give none. Binance’s South Africa FAQ says it is “actively engaged in” the crypto asset licensing process overseen by the FSCA. We could not read the FSCA’s approved crypto asset service provider list on 20 October 2026, so we do not state that Binance is or is not licensed. The ADGM licences in the footer of the en-ZA site are regulated by the FSRA, not the FSCA.

The FSCA’s 2021 public warning

The FSCA press release of 14 October 2021 states: “On 3 September 2021, the FSCA issued a public warning against Binance for suspected contraventions of financial sector laws, specifically the Financial Markets Act (FMA) as well as the Financial Advisory and Intermediary Services Act, 2002 (FAIS Act). Binance Group is not domiciled in South Africa or authorised to conduct any financial services business in the country.” The same release says that, effective 8 October 2021, Binance would restrict South African residents from opening new accounts to trade derivatives, restrict existing South African users from opening new derivative positions, and give current users 90 days to close existing positions; the FSCA “welcomes these corrective steps”. This is a 2021 document. A query of the FSCA media-release index for “Binance” on 23 October 2026 (listed in the sources) returned one record, this release; we did not check other FSCA sections. Binance’s own FAQ now says it is “actively engaged in” the FSCA licensing process.

ZAR deposits, P2P and banks: what Binance says

Binance states that ZAR can be deposited via Instant EFT or bank transfer, and that Binance P2P lets users trade with other South African users using ZAR. Its blog (7 May 2026) says Instant EFT “Funds arrive instantly” and bank transfer “May take 1-2 business days”. Binance states there are no minimum deposit requirements and that users can deposit or withdraw to “all major South African banks”. It also states the Binance Mastercard is available to South African users. These are Binance’s statements; we have not tested them.

Tax on crypto in South Africa (SARS)

SARS states: “Yes, normal income tax rules apply to crypto assets.” It also states “The onus is on taxpayers to declare all crypto assets-related taxable income.” (page last updated 20 March 2026).

Why we show no Binance button in South Africa

We show a sign-up link only where our evidence covers the country. We could not confirm a Binance licence in the official FSCA list, so there is no button and no code on this page. Do not use a false country or someone else’s identity to get around a check or restriction.

What the Prohibited list does and does not tell you

Binance publishes a List of Prohibited Countries (updated 5 January 2026). South Africa is not on it. That is a statement about Binance’s own list only: it does not say that Binance holds a South African licence, and it is not a ruling by the FSCA or any South African authority.

What we could not verify

On 20 October 2026 we did not find a primary source that confirms whether a Binance entity appears in the FSCA’s list of approved crypto asset service providers. The FSCA’s 3 September 2021 warning document itself was not available on the FSCA site on 23 October 2026 (HTTP 404), so what this page says about it comes from the FSCA’s own press release of 14 October 2021. On 23 October 2026 we did not read the FSCA’s list of approved crypto asset service providers and checked only the FSCA media-release index. Where a fact has no primary source we leave it out instead of repeating press reports.

How we checked this page

Each fact above comes from a Binance, FSCA or SARS page named in the sources, read on 20 October 2026 (the two FSCA sources — the press release of 14 October 2021 and the media-release index query — read on 23 October 2026). Binance’s own statements are labelled as Binance’s statements. We did not shift any check date: the dates shown are the dates the pages were read.

For how we check facts, see How we verify and the editorial policy. Related: Bybit in South Africa and Binance restricted countries; neither is a recommendation.
