Is Binance legal in Australia? Short answer
Facts read on 20 October 2026. Binance has two Australian arms with two different regulators. We make no legal ruling and show no Binance button in Australia.
| Entity | Regulator | Status | Source | Date |
|---|---|---|---|---|
| Investbybit Pty Ltd (“Binance Australia”) | AUSTRAC | Described as a registered digital currency exchange provider; external audit of AML/CTF controls ordered | AUSTRAC media release | publication date not confirmed, read 20 Oct 2026 |
| Oztures Trading Pty Ltd (Binance Australia Derivatives) | ASIC | AFS licence cancelled 6 Apr 2023; $10 million penalty ordered | ASIC 24-283MR, 26-055MR | 18 Dec 2024, 27 Mar 2026 |
Binance Australia’s AUSTRAC registration and the audit order
The AUSTRAC media release calls Investbybit Pty Ltd “Binance Global’s Australian arm” and an “AUSTRAC registered digital currency exchange provider”. It says AUSTRAC directed the company to appoint an external auditor of its AML/CTF controls and to nominate external auditors within 28 days. We did not confirm the publication date, so we cite it with our read date only. AUSTRAC also states that all businesses providing virtual asset services must be registered with AUSTRAC. We did not find a public AUSTRAC register entry to link, so registration is cited from the media release only.
Binance Australia Derivatives: licence cancelled, ASIC case and $10m penalty
ASIC states that on 6 April 2023 it cancelled the AFS licence of Binance Australia Derivatives. On 18 December 2024 ASIC sued Oztures Trading Pty Ltd, trading as Binance Australia Derivatives, alleging that 505 retail investors were misclassified as wholesale between 7 July 2022 and 21 April 2023. On 27 March 2026 ASIC reported that the Federal Court (Justice Moshinsky) ordered a $10 million pecuniary penalty, that 524 retail investors were exposed to high-risk crypto derivative products, and that more than 85% of its Australian client base was misclassified. These findings concern the derivatives arm and are not transferred to the spot exchange provider.
What this means for Australian users
We state facts only. Registration with AUSTRAC is a registration for AML/CTF purposes; it is not an ASIC licence for derivatives. This page makes no statement about AUD deposits, PayID or any return to Australia, because we have no cited source for them.

We show a sign-up link only where our evidence covers the country. We have no verified record that our Binance link works for Australian residents, so there is no button and no code on this page. Do not use a false country or someone else’s identity to get around a check or restriction.
